Susan Macpherson

Senior Litigation Consultant

Susan Macpherson, NJP Litigation Consulting

“We know how to sift through hours of deliberations and hundreds of questionnaire responses to identify what is driving jurors’ decisions, what they are missing and what would change how they process evidence and arguments. It is our job to translate the data into solutions and results.”

Susan Macpherson has been a professional trial consultant since 1976, when she joined NJP’s Midwest office. She has been retained by individual attorneys and by class action and MDL steering committees on more than 900 cases.

She supervises and conducts trial simulation research for civil litigation and complex criminal cases, and her work includes witness evaluation, community attitude studies, voir dire and juror questionnaires, jury selection and post-trial interviews. Her plaintiff work covers personal injury, medical negligence, product liability, FELA and Jones Act claims, and class actions against pharmaceutical and medical device manufacturers. She also works on antitrust, eminent domain, complex commercial and intellectual property matters, and with defense teams in complex criminal cases.

Susan is a member of the American Society of Trial Consultants, has served on its board of directors and chaired its Professional Standards Committee, and received ASTC’s Lifetime Achievement Award in 2007. She is a co-author of Jurywork: Systematic Techniques and her articles include “The Wired Juror, Unplugged” and “Tools to Keep Jurors Engaged” in Trial and “Getting the Answers You Need in Jury Selection” in the Nashville Bar Journal. Past clients include the NFL Players’ Association. She holds a B.S. with distinction in the behavioral sciences from the University of Minnesota.
